1. Introduction
Welcome to Migavibe, a platform designed specifically for heterosexual singles seeking connections through user-organized events.
Our Platform Family: We operate sister platforms for other communities:
- Migagay.com - For gay and lesbian singles
- Migaqueer.com - For queer and LGBTQ+ singles
While Migavibe focuses on heterosexual dating, all users are welcome to use the platform that best fits their preferences. We encourage you to choose the community where you'll feel most comfortable.
These Terms govern your use of our free platform for connecting users interested in singles events.
Migavibe is a technology platform only. We do not organize, host, manage, or supervise events. All events are created and run independently by approved users ("Event Organizers"). We are not responsible for offline interactions or user conduct.
If you don't agree, please do not use Migavibe.
2. Definitions
- "We," "Us," "Platform": Migamor GmbH and Migavibe.
- "You," "User": Any person using the Platform.
- "Event Organizer": Users we review/approve to list events.
- "Content": Text, photos, profiles, event listings you submit.
- "Services": All Platform features (listings, RSVP, messaging, profiles).
3. Nature of Service - Platform Only
We connect users. You handle all event logistics, safety, and compliance at your own risk. Events are free; no payments via Platform.
Event Size Restrictions:
- Maximum 10 participants per event (including organizer)
- Speed-dating events are strictly prohibited on Migavibe
- Violations result in immediate event removal and potential account termination
4. User Safety and Responsibilities
Events carry risks (injury, harassment, etc.). Our organizer review is best-efforts only—no guarantees of suitability, background checks, or event quality.
Safety Tips (Not Guarantees):
- Meet in public places.
- Share your location/plans with a friend.
- Report issues via Platform or local authorities.
- Trust your instincts—bail if uncomfortable.
- Attend events within the 10-person limit only.
You are responsible for your safety.
5. Data Collection, Use, and Retention
We collect basic info (email, profile, usage data) for Platform operation, fraud prevention, analytics, and optional marketing.
Marketing Communications: Optional. At signup, choose to receive emails/SMS/pushes from Migamor GmbH and affiliates about our dating products/events (unsubscribe anytime via link or account settings).

6. Event Organizers
Event Organizers are users we review and authorize on a best-efforts basis (e.g., basic profile check). Authorization is discretionary and revocable at any time without notice or compensation.
Organizer Requirements:
- Event Size Limit: Maximum 10 participants (including yourself)
- Prohibited Events: Speed-dating events are not allowed on Migavibe
- Free Events Only: No paid events or ticket sales through Platform
- Must comply with all applicable laws and venue regulations
- Responsible for all event logistics, safety, and liability
Fair-Play Requirement: Organizers must treat all participants equally regardless of gender, sexual orientation, or other protected characteristics. This includes:
- Accepting/rejecting RSVPs based on objective criteria only (e.g., event capacity, age requirements)
- Not discriminating against participants of the same gender as the organizer
- Maintaining professional and respectful conduct with all participants
- Violations may result in immediate removal of organizer status
We operate occasional "Official Migavibe Events" under the same rules.
No guarantee of organizer reliability. Organizers must comply with laws/Platform rules; violations lead to removal.
7. User Conduct and Prohibited Activities
You agree NOT to:
- Harass, abuse, stalk, threaten, or harm others.
- Post illegal, fraudulent, defamatory, obscene, or infringing Content.
- Impersonate others or misrepresent identity/age.
- Spam, scrape data, or reverse-engineer Platform.
- Violate laws (data privacy, safety, discrimination, etc.).
- Charge for events or collect payments via Platform.
- Organize events exceeding 10 participants.
- Organize or promote speed-dating events.
- Discriminate against participants based on protected characteristics.
Violations: Account suspension/termination, legal action, reporting to authorities.
8. Content Ownership and License
Your Content: You own it. You grant us a worldwide, royalty-free, perpetual license to use, display, modify, distribute for Platform operation and promotion.
Our Content: Platform design, features, trademarks owned by us. No license to you except to use Services per these Terms.
Content Removal: We may remove any Content (violations, legal, discretion). No obligation to monitor.
9. Intellectual Property
Platform, design, software, logos, trademarks are our property. You may not copy, modify, reverse-engineer, or create derivatives without written consent.
10. Disclaimers and Warranties
Services provided "AS IS." No warranties—express/implied—for merchantability, fitness, safety, uptime, or outcomes.
We don't guarantee:
- Organizer/user reliability, background, or intentions.
- Event safety, quality, or compliance with laws.
- Platform availability, accuracy, or error-free operation.
- Any specific results from Platform use.
- Compliance with event size restrictions or prohibition enforcement.
You assume all risks of using Platform and attending events.
11. Limitation of Liability
To the maximum extent permitted by law:
- No liability for indirect, consequential, punitive, or special damages (e.g., lost profits, emotional distress, injury, property damage).
- Direct liability capped at CHF 100.
- Excludes user conduct, events, offline harms, violations of event size/type restrictions.
Some jurisdictions don't allow liability limitations—this applies to fullest extent permitted.
12. Indemnification
You indemnify and hold harmless Migamor GmbH, affiliates, directors, employees, agents against all claims, losses, damages, liabilities, costs (including legal fees) arising from:
- Your use of Platform or Services.
- Your Content or conduct.
- Your violation of these Terms or laws.
- Events you organize or attend.
- Any injury, harm, or damage at events.
- Events exceeding size limits or speed-dating violations.
13. Termination
You: Delete account anytime via account settings (data retained per Section 5).
Us: Suspend/terminate accounts at any time for:
- Violations of these Terms
- Organizing events over 10 people
- Organizing speed-dating events
- Safety concerns or legal issues
- Any reason at our discretion—no notice required
Termination doesn't eliminate your obligations (indemnity, liability, data retention).
14. Governing Law and Disputes
Governing Law: Swiss law (excluding conflict-of-law rules). Zurich courts have jurisdiction.
Dispute Resolution:
- Informal Resolution: Contact us first—14 days good-faith negotiation.
- Mediation: If unresolved, mediation in Zurich (costs split).
- Binding Arbitration: If mediation fails—Swiss Rules of International Arbitration, Zurich venue, one arbitrator, English language. Decision final/binding.
No Class Actions: Disputes resolved individually only—no class/collective/representative actions, jury trials, or group arbitrations.
15. General Provisions
- Force Majeure: We're excused from liability for failures due to uncontrollable events (natural disasters, wars, pandemics, infrastructure failures).
- No Third-Party Beneficiaries: Terms are between you and us only.
- Assignment: We may assign/transfer these Terms; you may not without our written consent.
- Changes to Terms: We may update these Terms anytime. Notice via email/Platform. Continued use = acceptance. Material changes: 30 days' notice.
- Severability: Invalid provisions don't affect rest of Terms.
- Waiver: Our failure to enforce doesn't waive rights.
- Survival: Sections on liability, indemnity, IP, data, dispute resolution survive termination.
- Entire Agreement: These Terms (plus Privacy Policy) constitute entire agreement—supersede all prior agreements.

17. Acceptance of Terms
By creating an account, accessing, or using Migavibe, you acknowledge that you:
- Are at least 18 years old
- Have legal capacity to enter binding contracts
- Have read, understood, and agree to these Terms
- Understand Migavibe is designed for heterosexual singles (sister platforms available)
- Agree to organize/attend events of maximum 10 people only
- Understand speed-dating events are prohibited
- Assume all risks of offline interactions
18. Content Moderation and Illegal Content Reporting
Migavibe is committed to maintaining a safe and lawful platform. Below are our policies and procedures for reporting and addressing illegal or harmful content.
18.1 Notice and Takedown Procedure
Migavibe operates as a neutral intermediary platform. While we do not systematically monitor user-generated content, we respond promptly to reports of illegal or harmful material in accordance with Swiss law and our Terms of Service.
18.2 How to Report Illegal Content
If you encounter content on our platform that you believe violates Swiss law or our Terms, please submit a report via email to:

Required Information in Your Report
- Direct link to the content or a screenshot.
- Clear description of the violation (specify the law or Term breached).
- Your contact details (name, email, phone if applicable).
- Date and time you observed the violation.
Note: Incomplete reports may delay processing. False or abusive reports may result in account suspension.
18.3 Our Response Process
Upon receiving a valid report, we will:
- Acknowledge receipt within 2 business days.
- Assess the report within 5 business days.
- Take appropriate action, which may include:
- Removing or restricting access to the content.
- Suspending or terminating the user’s account.
- Reporting serious violations to Swiss authorities.
- Requesting additional information from the reporter.
- Declining action if the content does not violate laws or our Terms.
18.4 Counter-Notification
If your content was removed and you believe it was lawful, you may submit a counter-notification to
- Your contact details.
- Identification of the removed content (link/ID).
- A statement under penalty of perjury that the content was mistakenly removed.
We will review counter-notifications within 5 business days.
18.5 Important Limitations
By using our reporting system, you acknowledge that:
- We act only on specific, documented reports.
- We do not proactively monitor all user-generated content.
- Response times are best-effort estimates; delays do not constitute liability.
- Removal decisions are at our sole discretion.
- We are not liable for user-generated content or good-faith removal actions.
- False reports may lead to account termination.
18.6 Repeat Offenders
Users with multiple confirmed violations may face permanent suspension without prior notice.
18.7 Emergency Situations
For immediate threats to life or safety (e.g., violence, suicide, child endangerment), do not use our reporting system. Instead, contact:
